Cancellation right
Please note that the statutory cancellation right of 14 days only applies to online commerce, a general cancellation right in retail shops is not granted as per the Consumer Protection Act.
Purchasers, who are consumers in terms of the Consumer Protection Act, have the right to cancel this contract within 14 days (calendar days) without stating any reasons. Excluded from the right of return are products on sale, custom-made products (e.g. articles furnished with a name on request or made to order such as poker work and glass engravings) as well as articles already exhibiting signs of usage or damage resulting from improper use.
Products ordered specially for a customer are excluded from our returns policy.
The cancellation right is valid for 14 days from the day on which you, or a third party nominated by you which is not the carrier, took possession of the last article.
In order to exercise your cancellation right, you must inform us (CHARISMA am Stadtplatz - Schernthaner Lumpi GmbH, Stadtplatz 6, 5700 Zell am See, Austria, Tel. +43 (0)6542 73551, Fax +43 (0)6542 73551 22, E-mail shop@charisma-zellamsee.com) by means of an unambiguous statement (e.g. a letter sent by regular mail, e-mail or fax) regarding your decision to cancel this contract. Your cancellation must include the following detail: Customer number, invoice number, e-mail address, name of consumer, address of consumer, order date, delivery date, item number(s), reason for cancellation, refunding the purchase price or crediting it to a replacement order.
In order to preserve your cancellation right it is sufficient that you send off the message regarding the exercise of the cancellation right before the cancellation period expires.
Consequences of cancellation
If you cancel this contract, we are obliged to refund you the purchasing price (excluding additional costs like shipping, charge for payment on receipt of goods, fees,...) immediately and no later than within fourteen days from the day on which we received the message regarding your cancellation of the contract. To make the refund, we will use the same payment method as the one you used for the original transaction, unless otherwise expressly agreed with you; in no case will you incur any fees as a result of this refund. Should you still want to place a replacement order and set it off against the credit, please tell us when cancelling. We may withhold the refund until we have received the items back.
Please note the only the purchase price of the goods will be refundet excluding the costs for shipping.
Returning goods
You must return or hand over to us the goods without delay and in any event no later than within fourteen days from the day on which you informed us of the cancellation of this contract. The deadline is deemed to have been met if you send off the items before expiration of the period of fourteen days.
You shall bear the immediate costs for returning the goods.
It is important that the items do not show any signs of usage and are in their original packing (collapsible items in as-delivered condition). You must pay for any depreciation of the items if this depreciation can be attributed to handling the items in a manner not necessary to inspect them.
Please only send back parcels with sufficient postage, as otherwise we will have to pay postage due which we will deduct from your refund amount. The shipping costs you incur for the return consignment will not be refunded by us. We reserve the right not to accept freight collect consignments!
Cancellation right in case of poker work and custom-made products
Following your enquiry (please provide detailed information) on our website regarding poker work or other custom-made products, you will receive a detailed, written offer from us. If this appeals to you, please send us a written acceptance. Please note that when accepting our offer in writing, you waive your cancellation right after initiation of the ordered service. Before shipping, you will receive a photo of the customised item. Of course we endeavour to satisfy our customers and meet your requests accordingly. Customised portraits and individually made items cannot be subsequently returned!
