AREA OF APPLICATION
The following general terms and conditions shall apply exclusively to the business relation between the vendor Schernthaner Lumpi GmbH and the purchaser.

CONCLUSION OF CONTRACT AND AVAILABILITY
Our offers are subject to change and non-binding. The contract between the purchaser and Schernthaner Lumpi GmbH is formed by means of an order by the purchaser and acceptance by Schernthaner Lumpi GmbH.
The order placed by the customer (be it via online-shop, e-mail, fax or phone) becomes binding through payment. When ordering in the online-shop sending the order makes it binding, unless the item is not in stock. In this case we will contact you immediately and clarify whether you want to cancel the purchase or choose a replacement item, or will let you know the date of future delivery. The customer will receive within 24 hours an order confirmation by e-mail, which constitutes a binding acceptance. Acceptance of the order takes place by means of delivery of the item to the customer.

PAYMENT METHODS
We accept cash in advance, Visa- & Mastercard (mPay24), PayPal, cash on delivery (only in Austria and Germany) or payment in the shop if collecting the item in person. Find more details here...

WARRANTY/LIABILITY FOR DEFECTS
Schernthaner Lumpi GmbH guarantees that the contract products do not contain significant defects. Schernthaner Lumpi GmbH provides no warranty for normal wear and tear and for defects resulting from improper use. The customer must report obvious defects immediately and no later than within 14 days in writing and in as much detail as possible. Charisma am Stadtplatz - Schernthaner Lumpi GmbH renders the services with the greatest care, but is not liable for services provided or obtained by third parties.

PRICE
Prices are in Euro and incl. 20 % VAT without costs for packaging and shipping. Prices refer to the items illustrated in each case according to description. When updating the website, previous prices may be replaced. The price shown at the time of ordering shall apply in each case. Price changes and mistakes reserved.
Prices for non-EU countries are excl. VAT, more details about Tax-Free-Shopping can be found here...

Deliveries to foreign countries may incur duties, taxes and fees which are not included in the total price shown and are to be borne by you. We have no influence on these fees and unfortunately can not give you any information about their amount.

RESERVATION OF OWNERSHIP
The delivered goods remain our property until payment has been made in full. Assignment of the rights of the customer arising from the contract are not permitted without prior written consent. All images and photographs are the property of our company or the respective manufacturer and may only be used with written consent.

APPLICABLE LAW, PLACE OF JURISDICTION

Place of performance for all goods and services under this contract is the place of business of our online shop.

MISCELLANEOUS
The ineffectiveness, voidness or annulment of individual provisions does not affect the legal effectiveness of the remaining provisions of these general terms and conditions. The UN Convention on Contracts for the International Sale of Goods, as well as all provisions relating to the UN Convention on Contracts for the International Sale of Goods are expressly excluded.
